Terms of Service

1. Agreement to these Terms
These Terms of Service (the “Terms”) are an agreement between you (“you”, “Customer”) and sole proprietor (FOP) Yurii Oleksandrovych Ivasheniuk, registered in Ukraine and trading as SolaceIn (“SolaceIn”, “we”, “us”), governing your use of our websites, products and services, including the apps we publish for Atlassian products on the Atlassian Marketplace — such as Time And History, Unitix Flow and Manage Board (each, an “App”).
By installing, accessing or using the App, or by using this website, you agree to be bound by these Terms. If you use the App on behalf of an organization, you represent that you have the authority to bind that organization, and “you” refers to that organization.
2. The Apps and Atlassian Marketplace
Each App is installed into your Atlassian site from the Atlassian Marketplace. Your use of the Atlassian Marketplace and of Atlassian products is governed by Atlassian’s own terms and policies, which are separate from these Terms. Where Atlassian’s Marketplace terms conflict with these Terms with respect to purchasing, billing, refunds or license grants processed by Atlassian, Atlassian’s terms prevail.
3. Subscriptions, trials and fees
- Paid subscriptions, free trials, renewals, upgrades, downgrades and refunds for our Apps are processed by Atlassian through the Atlassian Marketplace under Atlassian’s pricing and refund policies.
- If your subscription expires or is not renewed, access to the App may be suspended until the subscription is restored.
- We may change the App’s pricing for future billing periods; changes take effect through the Atlassian Marketplace mechanisms.
4. License and acceptable use
Subject to these Terms and a valid subscription, we grant you a limited, non-exclusive, non-transferable right to use the App within your Jira site for your internal business purposes. You must not:
- copy, modify, distribute, sell, sublicense or lease the App, or make it available to third parties except as permitted by these Terms;
- reverse engineer, decompile or otherwise attempt to derive the App’s source code, except to the extent permitted by applicable law;
- use the App to violate applicable law, third-party rights or Atlassian’s terms;
- interfere with or disrupt the integrity or performance of the App or the data it processes.
5. Your data
Our Apps access your Atlassian data through Atlassian’s APIs, rely on the Atlassian permission model and do not grant users access beyond their existing permissions. What each App stores is described in our Privacy Policy. For the Time And History App in particular, which computes its reports on the fly from the Jira REST API on behalf of the requesting user:
- The App does not permanently store your Jira issue or changelog data, except within export files you create — by hand, or by a schedule you set up (see below).
- The App stores the data needed for its operation: user preferences (selected report, filters, columns, calendar and format choices), work calendars, access-settings grants, scheduled reports you create — their filter snapshot, timing and the email addresses of the recipients you enter — export files you create, feedback ratings you submit, and technical installation and account data required to connect to your Jira site (site identifiers, security keys, Atlassian account IDs).
- A scheduled report sends data out of your Jira environment by email. The App generates the report on the schedule its owner set, reading Jira with that owner’s own access, and emails the resulting XLSX file to the addresses the owner entered — up to ten of them, typed by the owner, with nobody added implicitly. Choosing the recipients is the owner’s decision: the App does not check whether an address belongs to your organization. Delivery uses Amazon Simple Email Service; the details are in our Privacy Policy and Data Processing Addendum.
- Export files you generate are private to the user who created them. The App’s Export History lists your 20 most recent exports, which you can delete there; older files are removed by us on request. Each run of a scheduled report produces such a file, listed in the schedule owner’s Export History.
- The App modifies Jira data only through actions you explicitly initiate: saving the “Edit issue” dialog, and saving a dashboard gadget’s configuration, which Jira stores as properties of that dashboard item and shows to everyone who can view that dashboard.
- After the App is uninstalled, stored data (configuration, work calendars, access grants, scheduled reports, export files and feedback) is retained to support reinstallation, and is deleted upon request (see Contact). Scheduled reports stop running once the App is uninstalled; deleting a schedule in the App deletes its configuration and its recipient addresses.
You retain all rights to your data. You grant us the limited right to process it solely to provide, maintain and improve the App.
6. Privacy
Our collection and use of personal data in connection with the App and this website is described in our Privacy Policy, which forms part of these Terms. We do not sell personal data. Where we process personal data on your behalf, our Data Processing Addendum applies. For data-protection questions or deletion requests, contact us at [email protected].
7. Intellectual property
The App, this website and all related materials (excluding your data and Atlassian’s properties) are owned by SolaceIn and protected by intellectual property laws. Except for the license expressly granted in these Terms, no rights are transferred to you. Feedback you provide about the App may be used by us without restriction or obligation.
8. Support and availability
- Support is provided in English via [email protected] (general inquiries) and [email protected] (technical issues), Monday–Friday, 09:00–18:00 Kyiv time (EET/EEST), excluding Ukrainian public holidays. We aim to provide a first response within two (2) business days — a service target, not a guaranteed SLA.
- Support includes: questions about the App’s functionality and configuration; investigation of suspected defects, with fixes scheduled where a defect is confirmed; reasonable workarounds; and recording of feature requests, without any commitment to implement them. Billing and licensing matters handled by Atlassian are redirected to Atlassian support.
- Support does not include: phone support or screen-sharing sessions, training, custom development or scripting, or issues caused by third-party products.
- We aim to keep the App available continuously but do not guarantee uninterrupted operation. Planned maintenance and factors outside our control (including Atlassian platform availability) may affect the service.
- We may modify the App, including adding, changing or removing features. If we discontinue the App or withdraw it from sale, we will give at least thirty (30) days’ advance notice via the Atlassian Marketplace listing, this website or the App itself; active subscriptions are handled in accordance with Atlassian Marketplace policies.
9. Disclaimer of warranties
The App and this website are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be error-free, that reported time calculations fit any particular legal, accounting or billing purpose, or that the App will meet your requirements.
10. Limitation of liability
To the maximum extent permitted by law, SolaceIn shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill, arising out of or related to these Terms or the App. Our total aggregate liability under these Terms shall not exceed the amounts you paid for the App through the Atlassian Marketplace in the twelve (12) months preceding the event giving rise to the claim.
11. Termination
You may stop using the App at any time by uninstalling it from your Jira site and cancelling the subscription through the Atlassian Marketplace. We may suspend or terminate access to the App if you materially breach these Terms and do not cure the breach within a reasonable time after notice. We may suspend access immediately, without a cure period, where your use poses a security risk to the App or third parties or is unlawful. Sections that by their nature should survive termination (including Sections 7, 9, 10 and 12) survive.
12. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, and disputes shall be resolved in the competent courts of Ukraine, unless mandatory law of your country of residence provides otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page with its “Last updated” date. Material changes take effect fourteen (14) days after publication (or on the date stated, if later), except changes required for legal, security or Atlassian Marketplace compliance reasons, which may take effect immediately; non-material changes take effect upon publication. By continuing to use the App after changes take effect, you accept the updated Terms.
